Forum Terms of Use
1. Acceptance of Terms
These Metaverse One TB006 Forum Terms of Use and Community Policy (“Forum Policy”) govern your access to and use of the Metaverse One online forum related to TB006 and other TrueBinding programs (the “Forum”).
By any of the following actions, you agree to be bound by this Forum Policy:
- Clicking “I Agree,” “Accept,” or a similar button during registration
- Accessing, viewing, posting to, moderating, or otherwise using the Forum
If you do not agree, you may not use the Forum.
This Forum Policy applies to all users, including:
- Healthcare providers and clinics using or interested in TB006
- Potential TB006 providers
- Investors and potential investors
- TrueBinding and Metaverse One personnel
- Any other individuals granted access, including moderators
Moderators are subject to all of the same obligations as any other user, in addition to any responsibilities described below.
2. Purpose of the Forum
The Forum is intended to:
- Enable TB006 providers and potential providers to share experiences, questions, and best practices
- Allow potential investors and other stakeholders to ask questions and understand the program at a high level
- Facilitate communication between the community, Metaverse One, and TrueBinding
The Forum is not:
- A place to discuss individual patients with identifying details
- A substitute for clinical judgment, professional medical advice, or regulatory submissions
- A system for adverse event reporting or product quality complaints
3. No Patient-Identifying Information (No PHI/PII)
You must not post, upload, or otherwise share any patient-identifying information in the Forum. This applies to text posts, comments, files, images, videos, audio, and any linked content.
3.1 Examples of prohibited patient-identifying information
- Patient name, initials, email, phone number, address, or social media handle
- Exact date of birth, full dates of service, or other unique dates tied to a patient
- Medical record numbers, insurance IDs, or other unique identifiers
- Photographs, videos, or audio showing a patient’s face or identifying characteristics
- Any combination of clinical details that could reasonably identify a specific patient
You are responsible for ensuring no PHI or PII appears in your posts.
3.2 Consequences of posting PHI/PII
If Metaverse One or a moderator believes content contains PHI/PII, Metaverse One may:
- Remove or modify the content
- Suspend or terminate Forum access
- Notify your organization
- Take any other steps needed to reduce privacy risk
If you accidentally post PHI/PII, you must:
- Immediately delete or report the post
- Notify Metaverse One via the designated method
4. Eligibility and Professional Responsibilities
- You are at least 18 years old
- If a healthcare provider, you are duly licensed and in good standing
- Non-clinical users will not present themselves as clinicians or offer clinical advice
You remain solely responsible for any decisions made based on Forum information.
5. User Conduct and Content Standards
You agree that you will not:
- Post PHI or PII
- Post unlawful, fraudulent, misleading, defamatory, harassing, or abusive content
- Post promotional or marketing content that violates healthcare, securities, or advertising laws
- Provide individualized medical advice for identifiable patients
- Engage in spam or irrelevant advertising
- Upload malware or harmful code
- Misrepresent your identity or affiliation
- Interfere with or disrupt the Forum
- Collect user data unlawfully
6. Moderation and Enforcement
Moderators may:
- Remove or edit content
- Move or close threads
- Recommend warnings, suspensions, or terminations
Metaverse One may at any time:
- Monitor or review content
- Remove or edit content
- Suspend or terminate access
- Restrict features or access
Moderation does not create liability for Metaverse One.
7. Intellectual Property and License to Metaverse One
You retain ownership of your posted content. By posting, you grant Metaverse One a worldwide, non-exclusive, royalty-free, sublicensable license to use, store, reproduce, modify, adapt, publish, distribute, and display content in connection with Forum operation and improvement.
You represent that you have the rights to post the content and that it does not infringe third-party rights or confidentiality obligations.
8. No Medical, Regulatory, or Investment Advice
You acknowledge that Forum content is not:
- Medical advice, diagnosis, or treatment recommendations
- Regulatory or legal guidance
- Investment advice or a solicitation
You are solely responsible for your clinical decisions, reporting obligations, and investment decisions.
9. Not a HIPAA-Compliant Environment
- The Forum is not designed to store or transmit PHI
- You must not treat the Forum as a secure clinical communication tool
- You must not upload or store patient records or PHI
Metaverse One is not a business associate under HIPAA for Forum use.
10. Reporting Concerns or Violations
You agree to report any content that:
- Appears to contain PHI
- Violates this Policy
- Appears unsafe, abusive, or otherwise problematic
Metaverse One may take action as it deems appropriate.
11. Changes to the Forum or this Policy
- Metaverse One may modify, suspend, or discontinue the Forum at any time
- This Policy may be updated periodically
Continued use constitutes acceptance of updated terms.
12. Termination
Metaverse One may suspend or terminate your access at any time, including for violations of this Policy.
You may stop using the Forum at any time.
13. Governing Law and Venue
This Policy is governed by California law. Disputes must be brought in the state courts of Santa Clara County or the U.S. District Court for the Northern District of California.
14. Entire Agreement; Relationship to Other Terms
This Policy supplements the general Metaverse One Terms of Use and Privacy Policy. Where they conflict regarding the Forum, this Policy controls.
